That's very true... I did not ask permission from anyone. But I didn't do this for a reason. Virtually all of the art I have was taken off one or another newsgroup by myself. Now, I have always assumed that those pictures would've been in the public domain, hence I saw no reason to contact the artist. A lot of the time the art makes no acknowledgment of the artist (the initials would've been stripped some time ago, or never added). Now, regarding your art, as I keep a list of the artists, I saw I only had a listing of you as "LS", so even if I had tried to contact you, I didn't know who you were. This goes for most of the people in the list (except most of those who use this group :). I actually have never come across copyrighted ascii art (except maybe from peter casso?), so I didn't bother to check the art on the homepages I knew. (Incidentally, I never did take the art off your page directly, which is why I didn't know who you were). Lastly, regarding SigZag. I made my program into shareware (hell, almost all programs on the net are shareware:). This means if you want to try it out, do... if you wanna pay a small registration fee, _please_ do :). The libraries in which I've put all the art are, as I have said, actually in the public domain - the actual program SigZag is the shareware. There is -no- way you can presume the copyright holders permission, as you do, and make money out of it. It's simply illegal. Yet you make it worse, the direction you seem to choose is continuation of the copyright violation, -despite- my letter which points it out to you and where I only ask for a removal of the art, after which I'd forget about it. My lawyer has now advised me to continue as follows: I demand you remove my art from your distribution now. I will download your distribution again in 7 days. Just because you find a picture not on a webpage, it DOES NOT mean that you have public domain... It has been the concensus of the ASCII artists to share our work with others-- FOR PRIVATE USE. Ah yes, this was bound to happen. So if I share my stuff with the
world, allow everyone to do with it whatever they please, use
it for sigs, whatever is fun, but draw a specific line that no one can make
money out of it without my permission, which is my right, then -I- am
an asshole when I react harsher after my first objection is waved
away. Well if I'm only nice if I allow people to make money of my copyrighted
creations and smile, an asshole I am then, or would have been, I you had spelled
my name right. I would perhaps have been nicer if permission was asked, or
if I would have received some sensible reaction. As an ASCII artist I'm
inactive, but this prospect for potential new ones hardly matches the motivation
you mentioned.

Sheesh! I yield. Two months ago I started writing this program intermintedly,
seeing as I had some spare time. A few weeks after I'd started, and was
almost finished the program, I almost gave up thanks to a few of the worst
little bugs imaginable! I decided to finish last week, and I did. It was
then I decided to see if it was possible to recouperate the costs of making
SigZag (since the compiler and the other software I needed are bloody expensive
thanks to good 'ol Microsoft! - and the headaches :L ).
And thus started the copyright arguements.
I personally didn't think anyone would pay the registration fee, but I figured,
what the hell!!? -> Mistake number 1! Like I said in my previous post, I don't
really visit the homepage's often (getting most art from the newsgroups), so I
really didn't expect any _copyrights_ to be on ASCII art! -> Mistake number 2:)
But of course, the artists have a right to be pissed off at me for apparently
selling their work... and I guess if I distributed only the program and left
it up to the users to paste in art they found, it would be a detriment to
my hole idea of making a program to make signatures easy to create!
So in summing up, although making SigZag shareware was just an experinment [me
secretly dreaming someone would want to pay:)], to remove almost 7000 pieces of
art is totally against the idea of making the program. So, I will make it
FreeWare. Now I will wait a few days before uploading the freeware version,
so if anyone objects to ascii art being distributed in a freeware package,
email me pronto.

How can someone object without being able to see the package? Mind that 'no objection' isn't a permission in any way. All Ascii Art is copyrighted even if you get it as a newsarticle. Of course any artist can get her/his art removed from your collection (or mine) any time. The trick is to be nice, to ask permission when possible and to show respect. Bloody hell people!! This program is suppose to help people who
have trouble moving around pictures and lines of text to make a
signature! The art I've included in this F'n program was just
to make their task of finding the god damn ascii pictures they
wanted easier - something that any dickhead with a friggin
computer can find on the net!!!
I never expected to find the narrowmindedness and egomaniacs I
have! All they can bloody scream about is that they think I'm

I can't be bloody bothered to try and argue this anymore! I am
keeping the program shareware, it started as an experiment and
it'll bloody end as one! But I'm removing all the friggin art
and let the users try and find them. I'm sure anyone who uses
the program will thankyou for supressing the art!

I think kangaroo should post a call for submissions, where people can submit their artwork. Once people read your terms, and aggree to them, the copyright laws will be in your favor. Just put a text box on your page where people can submit their ASCII art, and a clearly labled link saying something like "By submiting ASCII art for use in this program, you state that you have read and understood these _terms_and_conditions_. If you do not aggree to these terms, do not submit your art. Only submit your own art, or art which the auther has given you specific permission to submit." James-Joyce scholars (including me) debate copyright all the time, and I just read in the JJ Quarterly that 'fair use' is usually taken to mean 400 words or less. Since a word averages 5 chars, this makes 2k-- exactly the size of a standard 80*25 ascii pic. In fact my Ascii Dictionary is something like condensed 'fair use'. Another possible explanation that occurs to me: the ascii-artists has very little _fine control_ over the appearance of the work. Fonts make huge differences... so there just isn't that much potential for fine art. Here's something that I'm sure wasn't said before. Who says that the
pics we come up with are the original. I mean, it's not like we have
unlimited characters to work with, and ASCII art has been around since
the first home computer! My snail sig may have been done by someone else
many years ago. Just because I did it from scratch doesn't mean someone
didn't make it exactly like that once before.
My point is how can we be sure we are taking credit for an original
ASCII pic, when there is no way to prove that it is the original to
begin with. So one step deeper how can we copyright them if we can't
prove that. The odds that someone did the Mona Lisa exactly the same,
every brush stroke, is as close to impossible as you can get. But this
pic...

mean it's a total of 28 characters square, it's a popular sport, and
it's easy to make.
Not to say that what he wants to do is right, but is it legally wrong? I
have not done many ASCII drawings, but I know for a fact all the small
ones that I have done...like most of you...the odds that someone did
them before me is VERY GREAT!
I'm not sure a court would enjoy the odds on this argument.

Way back when there was a guy who offered $$$ for ascii versions of
company logos, I think so they'd be as exact a copy of some important
legal documents as possible. I don't know if he followed thru-- I did
some samples for him but hated it so I never sent them in... (Colin D,

The ascii art I do is FREEWARE, done for fun not profit, but that doesn't mean I give up all rights to it. It *IS* done for fun, we shouldn't get all heavy about it, but it is polite to credit people who were talented and generous enough to create neat free stuff for you to use. Otherwise you might put them off doing it in future. It would be nice if SigZag included a similar notice, and initails where known. I`m with you Andreas - it`s not size or complexity that counts.
My mini ascii 'portrait' was put together in a few seconds and I`m sure
anyone could make this:

Just a quick note - SigZag originally did have a notice saying something like this, ie all the artists want in return for you using their art is to leave their signatures on it.
