If copyright is automatic(if published, I believe, but net posting counts as
publishing) then a person claiming copyright on something that's already been
done by someone else (eg. the above Christmas smiley), they don't in fact have
a legitimate claim to copyright.

Otherwise I could go ahead and copyright  :)  (rediculous!)

I would/do claim ownership of the Cyberpopicon:  <+]::-{)}
and its variants(that directly relate to my appearance). . .
