No, he's right.  Somebody looking at the picture doesn't necessarily assume
the sides line up; I didn't see it.  This figure wouldn't stand up very well
on its own though--

My version of it:
set one and two down, standing on their edges (may be tricky.)
put three onto the top edge, so that it pushes one away from and two towards
you.
About halfway down, it will look like this.  continue, and you will get...
